These Terms of Service ("Terms") govern your access to and use of the TibiaEye Discord bot, the web dashboard at tibiaeye.com, and any related features (collectively, the "Service") operated by TibiaEye ("we", "us"). By signing in, installing the bot in your Discord server, or subscribing to a paid plan, you agree to these Terms.
1. Eligibility and accounts
You must be at least 13 years old (or 16 in jurisdictions that apply the GDPR's higher threshold) and have a valid Discord account to use the Service. You are responsible for maintaining the security of your Discord account and for all actions taken through it.
To install the bot in a Discord server, you must have administrator permissions in that server or be acting on behalf of an authorized administrator.
2. Service description
TibiaEye is an automated bot that scrapes public Tibia server pages (character profiles, online lists, deaths, highscores) you configure and posts notifications, embeds, and analytics to Discord channels you designate. Features include, but are not limited to:
- Death tracking for friends and enemies
- PZ-lock timers with countdowns
- Online/offline login notifications
- Experience and level-up analytics
- Frag and unjustified-kill tracking
- Highscores monitoring
3. Subscription and payment
TibiaEye is currently free, limited to one Discord server per organization. If paid plans are introduced, the price will be shown on tibiaeye.com/#pricing before you are asked to pay, nothing will be charged without your explicit checkout, and paid plans will be billed through Stripe and can be cancelled at any time.
4. Refunds
We offer a 7-day refund window for first-time subscribers, provided you have not misused the Service. Refund requests after 7 days are at our discretion. Setup fees are non-refundable once bot installation has been completed.
5. Acceptable use
You agree not to:
- Use the Service to harass, dox, stalk, or otherwise abuse individuals
- Attempt to overload, disrupt, or reverse-engineer the Service
- Circumvent rate limits, scraping restrictions, or access controls imposed by us or by the Tibia servers we scrape
- Use the Service to violate the terms of service, acceptable use policies, or intellectual property rights of any third-party Tibia server
- Resell or sublicense the Service without our written consent
If a Tibia server operator requests that we stop scraping their site, we may disable the relevant scraper for all users at our discretion without refund.
6. Your content
You retain ownership of configuration data you create inside the dashboard (tracking lists, guild settings, channel assignments). You grant us a limited, non-exclusive license to store and process that data solely to provide the Service.
7. Intellectual property
The TibiaEye name, logo, bot code, dashboard, and all associated materials are owned by us and protected by applicable copyright and trademark laws. Nothing in these Terms grants you a licence to our intellectual property except the limited right to use the Service in accordance with these Terms.
Tibia is a trademark of its respective owner. TibiaEye is an independent project and is not affiliated with, endorsed by, or sponsored by CipSoft GmbH or any individual Tibia private-server operator.
8. Service availability
We strive for high availability but do not guarantee uninterrupted service. The Service depends on third parties (Discord, Stripe, the Tibia servers you configure, Cloudflare) whose availability is outside our control. Scheduled maintenance and unplanned outages may occur. No service-level agreement is provided unless explicitly negotiated in writing.
9. Termination
You may terminate your account at any time from the dashboard. We may suspend or terminate your access for breach of these Terms, non-payment, fraudulent activity, or if continued operation becomes legally or technically infeasible. On termination, your right to use the Service ceases immediately; data is deleted in accordance with the Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DATA SCRAPED FROM TIBIA SERVERS IS ACCURATE, COMPLETE, OR TIMELY.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim, or EUR 100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill.
12. Governing law
These Terms are governed by the laws of Spain, without regard to conflict-of-laws principles. Any dispute will be resolved in the competent courts of Madrid, Spain, except where mandatory consumer protection law grants you the right to bring a claim in the courts of your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the TibiaEye Discord and via email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
